These Terms of Service and Terms of Sale ("Terms") govern your use of www.sunrisefineart.com and any purchase of artwork, prints, sculptures, framing, or related products and services from Sunrise Fine Art.

By accessing our website, submitting an order, making a payment, or purchasing artwork from Sunrise Fine Art, you agree to these Terms.

Please read them carefully before making a purchase.

References in these Terms to "Sunrise Fine Art," "we," "us," or "our" mean Sunrise Fine Art.

References to "you" or "customer" mean the person purchasing artwork or otherwise using our website.
2. Artwork and Product Information
We make reasonable efforts to provide accurate descriptions, photographs, dimensions, materials, techniques, edition information, artist information, and other details regarding the artworks displayed on our website.

Because artwork is inherently visual and often handmade, certain variations may occur.

In particular:
- colors displayed on a screen may differ slightly from the appearance of the physical artwork
- dimensions may be approximate
- handmade, hand-painted, hand-embellished, mixed-media, and sculptural works may include natural variations
- frames and framing examples shown in photographs may differ in color, finish, profile, or appearance from how they appear in person
- photographs may not fully reproduce texture, depth, brushwork, surface effects, metallic elements, or other physical characteristics of an artwork.These natural differences are not considered defects.

If a particular characteristic of an artwork is especially important to you, we encourage you to contact us before purchasing. We may be able to provide additional photographs, videos, measurements, or information.
3. Original Artworks and Limited Editions
Our inventory may include original works of art, limited editions, signed editions, embellished editions, prints, sculptures, mixed-media works, and other types of artwork.

Where an artwork is described as an original, we represent it as an original work by the identified artist based on the information and provenance available to us.

Where an artwork is described as a limited edition, edition numbers, artist proofs, or similar information will be provided where applicable and available.

Hand-embellished works may contain individual variations resulting from the artist's hand-finishing process.
4. Certificates of Authenticity
Where stated in the artwork description or agreed as part of a sale, an artwork will be supplied with a Certificate of Authenticity ("COA").

The certificate may be issued or signed by the artist, Sunrise Fine Art, the publisher, or another appropriate party depending on the artwork.

The precise form and issuer of the COA may vary from one artwork to another.

A Certificate of Authenticity does not constitute an independent appraisal or guarantee of future market value.
5. Availability
Many artworks offered by Sunrise Fine Art are unique, one-of-a-kind, or available in very limited quantities.

An artwork appearing on our website is therefore not guaranteed to remain available until an order has been accepted.

Artwork may also be offered through galleries, exhibitions, online marketplaces, art fairs, artists, agents, or other sales channels.

If an artwork is sold or otherwise becomes unavailable before we are able to fulfil your order, we will inform you and refund any amount paid for that unavailable artwork.

We are not responsible for any additional loss resulting from an artwork becoming unavailable before an order is accepted.
6. Orders and Acceptance
Submitting an order or making an enquiry does not necessarily mean that your purchase has been accepted.

A binding sale is generally created once:
- the artwork and price have been agreed
- payment has been successfully received or otherwise approved
- Sunrise Fine Art has accepted the order.

We reserve the right to decline or cancel an order where reasonably necessary, including where:
- an artwork is unavailable
- an incorrect price or description was displayed
- payment cannot be verified
- we reasonably suspect fraud or unauthorized activity
- shipping to the destination is not reasonably possible
- the order violates applicable law
- an obvious technical or administrative error has occurred.

If we cancel an accepted order for reasons unrelated to misconduct by the customer and payment has already been received, we will refund the applicable amount paid.
7. Prices
Prices are displayed in the currency indicated on the website, invoice, quotation, payment request, or other sales communication.

Prices may change at any time before an order is accepted.

The price applicable to a completed purchase will be the price confirmed at the time the sale is agreed.

Unless expressly stated otherwise, prices do not automatically include customs duties, import taxes, VAT, sales taxes, brokerage fees, local charges, or similar government-imposed costs that may apply in the destination country.

Shipping may be included in the artwork price in some cases and charged separately in others. The applicable shipping arrangement will be shown or communicated before the purchase is completed.
8. Pricing Errors
Although we make reasonable efforts to ensure pricing information is accurate, mistakes may occasionally occur.

If an artwork has been listed at an obviously incorrect price due to a typographical, technical, currency-conversion, or administrative error, we are not obligated to supply the artwork at the incorrect price.

If payment has already been made, we may offer you the opportunity to purchase the artwork at the correct price or cancel the order and receive a refund.
9. Payment
Payments may be processed through PayPal or other payment methods or payment processors made available by Sunrise Fine Art.

By providing payment information, you represent that you are authorized to use the selected payment method.

Third-party payment providers may impose their own terms, privacy policies, verification procedures, currency conversion rates, or transaction requirements.

We are not responsible for independent fees or currency conversion charges imposed by your bank, card issuer, PayPal, or another payment provider.

Ownership of an artwork does not transfer to the customer until payment has been received in full.
10. Shipping
We ship artwork to customers in the United States and internationally.

Shipping methods vary according to the size, value, destination, construction, and nature of the artwork.

We may use professional couriers, freight companies, art shippers, postal services, or other logistics providers.

Any delivery timeframe provided is an estimate unless we expressly agree otherwise in writing.

Delivery may be affected by circumstances outside our reasonable control, including:
- customs procedures
- carrier delays
- weather
- strikes
- transportation disruptions
- security inspections
- public holidays
- incorrect delivery information
- remote delivery locations
- events of force majeure.

We will make reasonable efforts to assist with delivery issues but cannot guarantee a specific delivery date unless expressly agreed in writing.
11. International Shipping, Customs, and Import Charges
Customers purchasing artwork for international delivery are responsible for ensuring that the artwork may lawfully be imported into the destination country.

Unless expressly stated otherwise in writing, the customer is responsible for any:
- customs duties;import taxes
- VAT or GST
- brokerage charges
- customs processing fees
- local taxes
- other charges imposed by authorities or carriers in the destination country.

Customs classifications and tax treatment may vary between jurisdictions.

Any information we provide concerning customs duties, tax exemptions, import classifications, or similar matters is provided for general informational purposes and should not be treated as tax or legal advice.

The final determination is made by the relevant customs or tax authority.
12. Delivery Information
You are responsible for providing a complete and accurate shipping address, telephone number, email address, and any other information reasonably required for delivery.

If an artwork cannot be delivered because the information supplied by the customer is incorrect or incomplete, additional shipping or storage costs may be charged to the customer where permitted by law.

Where a delivery requires a signature, identification, appointment, customs clearance, or communication with the courier, the customer is responsible for reasonably cooperating with the delivery process.
13. Inspection Upon Delivery
Please inspect the packaging and artwork promptly upon delivery.

If an artwork or its packaging appears to have been damaged during transportation, please photograph the package before opening it where reasonably possible.

Photographs should include:
- the exterior packaging
- shipping labels
- any visible damage to the packaging
- internal packaging
- the artwork and any damage to the artwork.

Retain all original packaging until the matter has been resolved.
14. Damage in Transit or Incorrect Artwork
If an artwork arrives damaged, materially differs from the artwork ordered, or you receive the incorrect artwork, please contact us as soon as reasonably possible at sunrisefineart@gmail.com

Please include your name, order details, photographs, and a description of the issue.

For shipping damage, we recommend notifying us within 48 hours of delivery whenever reasonably possible because carriers and insurers may impose time limits for claims.

We will review the circumstances and, where appropriate, work with you and the shipping or insurance provider to arrange a repair, replacement, return, refund, or other reasonable solution.

Nothing in this section limits any mandatory consumer rights that apply under applicable law.
15. Returns and Cancellations
Because artworks are unique, limited in availability, fragile, and frequently prepared, framed, packed, or shipped specifically for an individual customer, all sales are final to the fullest extent permitted by applicable law unless we agree otherwise in writing.

This policy does not affect any mandatory legal rights you may have because an artwork is defective, damaged, materially misdescribed, or because applicable consumer law provides you with a right of cancellation or return.

If you believe that you have a legal right to cancel or return an order, please contact us promptly at sunrisefineart@gmail.com before returning the artwork.

No artwork should be returned without prior communication with Sunrise Fine Art.

Where a return is accepted, the artwork must generally be returned:
- in the same condition in which it was received
- with all accompanying certificates and documentation
- using appropriate protective packaging
- by a trackable and appropriately insured shipping method
- in accordance with any return instructions provided by Sunrise Fine Art.

Unless applicable law or an agreement with us provides otherwise, the customer is responsible for the cost and risk of an authorized return made because the customer has changed their mind.
16. European and United Kingdom Consumer Rights
If you are a consumer located in a jurisdiction that provides mandatory cancellation or withdrawal rights for distance purchases, including certain consumers in the European Economic Area or United Kingdom, those statutory rights apply where required by law.

Certain online purchases may carry a statutory cancellation period.

However, statutory cancellation rights may not apply to certain categories of goods, including goods made to the customer's specifications or clearly personalized, subject to applicable law.

If a statutory right of withdrawal applies to your purchase, you must notify us within the applicable legal period.

Where permitted by law, you may be responsible for the direct cost of returning the artwork when exercising a change-of-mind withdrawal right.

These Terms do not waive or reduce any consumer right that cannot legally be waived or reduced.
17. Custom, Commissioned, Personalized, or Special Orders
Orders that are commissioned, customized, altered, resized, personalized, specially framed, specially embellished, specially produced, or otherwise prepared according to the customer's specific instructions may be treated as custom or personalized orders.

Once work has begun on a custom or specially prepared order, cancellation or modification may not be possible.

To the fullest extent permitted by applicable law, custom and personalized orders are non-returnable and non-refundable except where the goods are defective, materially misdescribed, or another mandatory legal right applies.

Any deposit or advance payment relating to a commissioned or custom work will be governed by the written terms agreed for that particular order.
18. Framing
Where framing is included or purchased separately, we make reasonable efforts to provide the agreed frame style and finish.

Minor variations in color, texture, joins, wood grain, metallic finish, liner material, moulding batches, or other characteristics may occur.

If a particular frame becomes unavailable after an order is placed, we will contact you regarding a reasonably comparable alternative before making a material substitution.

Artwork that has been specially framed or reframed at the customer's request may be considered a customized order where permitted by applicable law.
19. Ownership and Risk
Legal ownership of an artwork remains with Sunrise Fine Art until the purchase price has been paid in full.

Responsibility for loss or damage during shipping will be determined in accordance with the applicable shipping arrangement, carrier terms, insurance coverage, and mandatory consumer law.

Nothing in these Terms transfers intellectual property rights in an artwork to the purchaser.

Purchasing a physical artwork means that you own that physical object. It does not automatically give you copyright, reproduction rights, licensing rights, merchandising rights, or other intellectual property rights in the artwork.
20. Intellectual Property
The artwork, photographs, artist biographies, text, graphics, branding, logos, website design, and other content appearing on www.sunrisefineart.com may be protected by copyright, trademark, and other intellectual property laws.

Unless expressly authorized, website content may not be copied, reproduced, republished, distributed, commercially exploited, or used to create derivative material without permission from the relevant rights holder.

Purchasing an artwork does not grant permission to commercially reproduce the artwork or use its image for commercial purposes.
21. Resale and Future Value
Art markets are inherently unpredictable.

Sunrise Fine Art does not guarantee:
- the future market value of an artwork
- appreciation in value
- resale value
- investment performance
- liquidity
- the ability to resell an artwork at any particular price.

Statements regarding artists, previous prices, comparable works, market history, rarity, or similar matters should not be interpreted as financial or investment guarantees.
22. Website Availability and Information
We aim to keep our website accurate and available, but we do not guarantee uninterrupted access.

The website may occasionally contain errors, outdated information, technical issues, or unavailable content.

We may modify, suspend, or discontinue website features where reasonably necessary.

Artist biographies and other historical or descriptive information are provided based on sources we reasonably believe to be reliable, but minor errors or differences between sources may occur.
23. Limitation of Liability
To the fullest extent permitted by applicable law, Sunrise Fine Art will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of our website or the purchase of artwork.

Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any rights or remedies that cannot legally be excluded under applicable consumer protection law.
24. Force Majeure
We will not be responsible for a failure or delay in performing our obligations where that failure or delay results from circumstances beyond our reasonable control.

Such circumstances may include natural disasters, fire, war, civil unrest, terrorism, governmental actions, border closures, customs delays, epidemics, labor disputes, carrier disruptions, transportation failures, power or communications outages, or other events beyond our reasonable control.
25. Fraud and Unauthorized Transactions
We reserve the right to take reasonable steps to verify the identity of a purchaser or the legitimacy of a transaction.

We may suspend or cancel an order if we reasonably believe a transaction is fraudulent, unauthorized, unlawful, or presents a significant security risk.

We may cooperate with payment providers, financial institutions, law enforcement agencies, carriers, insurers, or other appropriate parties in investigating suspected fraud.
26. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

By using our website or purchasing from us, you acknowledge that you have had the opportunity to review our Privacy Policy.
27. Third-Party Services
Our website may use or link to services operated by third parties, including Webflow, PayPal, shipping providers, social media platforms, and other service providers.

Those third parties may have their own terms and privacy policies.

Sunrise Fine Art is not responsible for the operation or independent practices of third-party websites or services.
28. Governing Law
These Terms and any transaction with Sunrise Fine Art are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country or state provide otherwise.

Subject to any mandatory rights available to consumers, disputes arising from these Terms or a transaction with Sunrise Fine Art will be subject to the jurisdiction of the appropriate courts located in Palm Beach County, Florida.

Nothing in this section deprives a consumer of protections that cannot legally be excluded under the laws applicable to that consumer.
29. Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
30. No Waiver
If we do not immediately enforce a provision of these Terms, that does not mean that we waive our right to enforce it later.
31. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, website, services, payment methods, legal requirements, or operating practices.

The version applicable to a purchase will generally be the version in effect when the purchase is made.

The effective date at the top of these Terms will indicate when the current version became effective.
